In order to grant a license for the Sketchframer application (hereinafter, the "Software"), Martinix SRL must collect personal data from the licensee and its users. This data may be organized in a database owned by Martinix SRL and subjected to processing in accordance with Law No. 18.331 and Decree No. 414/009, their amendments and related provisions, and pursuant to the terms of this privacy policy (hereinafter, the "Privacy Policy").
Accessing, registering for, and using the Software implies the reading, understanding and express acceptance of the Privacy Policy and its conditions by the user. The user acknowledges and accepts that refusing to allow the collection of data prevents the granting of the right to use the Software.
Users who use the Software and provide personal data of third parties guarantee that they have collected the data in accordance with Law No. 18.331 and Decree No. 414/009, their amendments and related provisions, and that they have informed the data subjects of the existence of the Privacy Policy.
The personal data collected may include: names, email addresses, usernames, passwords, billing data, cookies, IP information and all other data necessary for the identification of users who register to use the platform and other data provided by users that is necessary to operate the Software and comply with its terms and conditions.
Sensitive data shall not be collected or subjected to processing.
In this regard, personal data shall be used exclusively for the purposes of executing the terms and conditions of the Software, as well as complying with legal and regulatory provisions that require the collection and transmission of data, and to allow users access to the Software, as well as for the corresponding billing.
Martinix SRL may use the personal data provided by users who use the Software to promote and provide other services different from the Software license and services of its partners.
The personal data that Martinix SRL collects may be stored and processed in Uruguay, the United States of America or in any other country in which Martinix SRL or its agents are established, endeavoring to provide similar levels of protection adequate to international personal data law standards. Consequently, by using the Software and accepting the Privacy Policy, express consent is given to any international transfer of personal data under these conditions.
The user of the Software agrees that Martinix SRL may access, retain, disclose and transfer to third parties personal data, which includes account information, in the following cases: (a) to comply with any law, regulation, and before any order of a competent judicial or administrative authority; (b) to execute and enforce the terms and conditions of the Software, including the investigation of any possible breach thereof; (c) to detect, prevent or otherwise resolve issues related to fraud, security or technical difficulties (including, among other things, spam filtering); (d) to respond to User assistance requests; or (e) to protect the rights, property or safety of Martinix SRL, its users and the general public.
Martinix SRL shall not be liable for the exercise or non-exercise of rights under this Agreement.
Users of the Software may at any time exercise the rights of access, rectification, updating, inclusion and deletion, granted by Law No. 18.331, its amendments and related provisions, before MARTINIX SRL through the "Contact" form.
Users of the Software may receive correspondence with promotions from Martinix SRL, and/or notices of products or services related to Martinix SRL, or other related companies. Users of the Software may at any time cancel their subscription to such email notices, in whole or in part, by clicking the "Unsubscribe" link located at the bottom of the emails sent by Martinix SRL.
Martinix SRL shall adopt the measures that are necessary to ensure the security and confidentiality of personal data. This includes physical security measures and access only by employees, subcontractors and service providers of Martinix SRL who need to access personal data to provide the Software license, including those who provide billing services, cloud providers, hosting and technical support, who shall be subject to confidentiality clauses and professional secrecy obligations, as provided for in art. 302 of the Criminal Code.
Martinix SRL will make every effort to protect the personal data provided by users through this website. However, if in compliance with contractual obligations assumed with third parties, or in the event that there is a court order in this regard, it may disclose some of the data in its possession.
